1. The agreement
NearMatch is provided by Mohamed said Raoudh, 37D avenue des Genottes, 95800 Cergy, France ("we", "us"). By creating an account or using NearMatch, you agree to these Terms and to our Privacy Policy. The app asks you to accept both before you can use it. If you do not agree, do not use NearMatch.
2. Who can use NearMatch
- You must be at least 18 years old. NearMatch is for adults only, everywhere.
- One person, one account. Your account is personal: do not share it, sell it or let anyone else use it.
- You may not use NearMatch if we have banned you before, or if the law where you live does not allow you to.
3. How NearMatch works
- Check in where you really are. You check in at a real place (a bar, a café, a gym, a park). At check-in, your phone's location must put you within about 100 m of the place. While you are checked in, the people at the same place can see your profile.
- A match starts a countdown. When two people like each other, they match, and a countdown starts. The app shows how long you have. There are no extensions.
- Meet and confirm with the code. To keep the match, meet in person before the countdown ends and confirm the meeting with the 4-digit meeting code shown in the app. A confirmed match and its conversation stay until one of you ends it.
- Otherwise the match ends. If you do not confirm in time, or if one of you leaves the place before meeting, the match expires and its conversation is deleted. This is how NearMatch is designed, not a malfunction.
4. Your account
You sign in with Apple or Google. When you sign up, we verify your phone number once by SMS; afterwards it is used only to help you recover your account. Keep your information accurate, and tell us at [email protected] if you think someone else is using your account. You are responsible for what happens on your account.
5. Your content
Your photos, profile and messages stay yours. You give us a non-exclusive, worldwide, royalty-free licence to host, store, display and process them only to run NearMatch, including the automated checks described in our Privacy Policy. The licence ends when you delete the content or your account, except for copies we must keep for safety (Privacy Policy, section 5).
Your photos must be real, recent photos of you. Only post content you have the right to share. You are responsible for what you post and send.
6. What is not allowed
NearMatch has zero tolerance for objectionable content and abusive users. You must not:
- post or send nudity, sexual content or sexually explicit messages that the other person did not ask for;
- post, send or ask for anything that sexualises or endangers a minor, in any way;
- harass, threaten, bully, stalk or intimidate anyone, on NearMatch or after meeting through it;
- post hate speech, or attack anyone for their race, ethnicity, nationality, religion, disability, sex, gender identity or sexual orientation;
- post violent or graphic content, promote weapons, drugs or anything illegal, or encourage self-harm;
- pretend to be someone else, use another person's photos, or mislead people about who you are;
- scam people, ask for money or gifts, offer paid sexual services, or advertise or sell anything;
- share someone else's private information, or photos of them, without their permission;
- check in at a place where you are not, fake your location, or use bots, scripts or automated access;
- copy, scrape, reverse-engineer, overload or disrupt NearMatch, or get around a block, a ban or any of our safety measures.
7. Reporting, blocking and moderation
- Report anyone, from their profile or from your conversation, with the flag icon. Tell us what happened; reports are confidential, and the person you report is not told who reported them.
- Block anyone the same way. Blocking ends any match you have together, deletes your conversation for both of you, and stops you from seeing each other.
- We act within 24 hours. Our moderators review reports and act on objectionable content within 24 hours: we remove content that breaks these Terms and ban the account that posted it.
- Automatic filters. Names, bios and messages are checked against a list of prohibited terms, and photos are checked automatically, with your consent, before anyone can see them. Content that fails is refused.
If you are in danger, contact your local emergency services first. To report a safety issue, including a suspected minor, write to [email protected].
8. Meeting people safely
Meeting new people carries risk. We do not run criminal background checks, and we cannot guarantee who anyone is or how they will behave. The "verified" badge only means that a selfie matched that person's profile photos. Meet in a public place, tell a friend where you are going, stay in control of how you get home, and leave if you feel unsafe. You are responsible for your interactions with other users.
9. Ending your account
- You can delete your account at any time in the app (Profile, Delete account). Deletion is immediate and permanent: your account cannot be restored. If you cannot use the app, ask us as explained on getnearmatch.com/account/delete; we handle every request within 30 days.
- We can suspend or ban your account, and remove your content, if you break these Terms, if you put anyone at risk, or if the law requires it. A banned person may not open a new account. If you think we made a mistake, write to [email protected].
10. Changes to NearMatch and to these Terms
NearMatch keeps evolving: we may add, change or remove features. If we change these Terms in a way that matters, we tell you in the app and ask you to accept the new version before it applies to you. The date at the top shows the current version.
11. Liability
NearMatch is provided "as is" and "as available". To the extent the law allows, we make no promise that it will always work or be error-free, and we are not liable for indirect or consequential losses, or for what other users do. Nothing in these Terms limits liability that cannot be limited by law, or takes away the rights consumer law gives you where you live.
12. Governing law
These Terms are governed by the law of the country where Mohamed said Raoudh is established. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts there.
